What is the Difference Between Adult and Juvenile Felony Drug Charges?<\/span><\/h2>\n

A minor who commits a crime in Arizona is subject to Arizona\u2019s juvenile court system.<\/span><\/p>\n

A juvenile court is similar to an adult court. But juvenile courts may focus more on rehabilitation than punishment and incarceration. The goal of a <\/span>juvenile court<\/span> should be to guide the child towards being a productive and successful member of society.<\/span><\/p>\n

But that changes if your child is close to their eighteenth birthday. A prosecutor may lobby for an adult court to try an older teenager, especially if the offense is particularly severe.\u00a0<\/span><\/p>\n

What is Juvenile Control of Drugs?<\/span><\/h3>\n

Another factor of juvenile possession is control of the illegal substance.\u00a0<\/span><\/p>\n

To convict a juvenile of possession, a prosecutor must prove the juvenile was actually controlling the drugs. This often involves proving the juvenile was holding the drugs or had them in a pocket or a backpack. It is often enough for a prosecutor to show that the juvenile had control of the area where police discovered the drugs.\u00a0<\/span><\/p>\n

For example, if police find drugs in a juvenile\u2019s car, the fact that it is their car is enough to establish control. This is also the case with school lockers and bedrooms.\u00a0<\/span><\/p>\n

What are the Penalties for Juvenile Drug Possession?<\/span><\/h2>\n

Anytime a court charges a juvenile with possession, there are potentially serious consequences. Depending on the drug in question, if your child faces adult felony drug charges, they could be looking at anything from prison time to heavy fines.<\/span><\/p>\n

Juvenile courts in Arizona<\/span> have a somewhat wider range of options than adult courts. This can leave many people wondering what to expect in juvenile court<\/a>. Some of the possible penalties for drug possession in juvenile court are:<\/span><\/p>\n

Drug Counseling\u00a0<\/span><\/h3>\n

The difference is that the juvenile can complete diversion orders without going before juvenile court. If the juvenile successfully completes the diversion program, the courts will essentially dismiss the charges. In very rare cases, detention is the penalty for juvenile drug charges. Detention may be home confinement or placement with a relative or foster home.
